USER AGREEMENT
The Terms of Use is a legal agreement between Kounouz (“we”, our”, “company”) and yourself (“you”, “user”), regarding your use and access to the Kounouz website, as well as any other form of media platform; including but not limited to our email, mobile applications and any form of social media.
www.Kounouz.com is a site operated by Kounouz Ltd. We are registered in England and Wales with our registered office at Unit 4, St Marys Industrial Park, Talbot Road, Hyde SK14 4HN, United Kingdom. Our Kounouz headquarters is located in Morocco and our email address is hello@kounouz.com.
YOUR INFORMATION
Any individual placing an order on our site must be at least 16 years of age. Users must acknowledge that they are legally capable of entering into binding contracts and must be a resident in one of the serviced countries.
CONTRACT WITH KOUNOUZ
Upon placing your order, you will receive an order acceptance and dispatch email. We will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (the "Dispatch Confirmation"). The contract between us ("Contract") will only be formed when We send you the Dispatch Confirmation.
We are entitled to refuse any order made by you for any reason.
When making a request you undertake that all details you provide to us requesting goods or services are true and accurate, that you are an authorised user of the credit or debit card used to make your request and that there are sufficient funds to cover the cost of the goods and services. It is your responsibility to inform us of any changes to these details as soon as possible.
SHIPPING & DELIVERY
Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation or within 30 days of the date of the Dispatch Confirmation, unless there are exceptional circumstances.
If you wish to dispute the delivery of your order, you have 14 days starting from the day of tracking by the carrier as fulfilled (i.e., updated as delivered to the address set out in the Dispatch Confirmation).
IMPORT DUTY & TAX
Any order from outside of the UK, may be subject to import duties and taxes which are collected upon arrival of delivery at the requested location. You will be responsible for payment of any import duties and taxes. Please note that any of these charges are to the discretion of your local government where we have no control or contact for such charges. Please contact your local customs department for further information.
You must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.
PRICE AND PAYMENT
All prices are payable as seen on the website. Prices on the website include VAT for UK purchases but excludes delivery charges. Delivery charges are shown separately at checkout and must be paid in advance.
Payment shall be made by you through the website and shall be declared as paid once we have received the requested funds in respect of the full amount stated in the order.
Prices are subject to change without notice but will not affect orders that have already been accepted.
Our site contains a large number of Products and it is always possible that some may be incorrectly priced. We will normally verify prices as part of our dispatch procedures, and we will charge the lower amount when dispatching the product to you. If the correct price is higher than the price stated on the website, we will either contact you for instructions before dispatching the order or reject it completely and notify you via email. You may also contact us directly to resolve the issue.
We are under no obligation to provide the product to you at the incorrect price, even after sending a Dispatch Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognised by you as a miss-pricing.
Payment for all Products must be by credit or debit card. We also accept payments via Google and Shop pay.
The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.
Only one promotion / discount code may be used per order. All promotional / discount codes will be valid for one purchase, only unless stated otherwise by Kounouz.
We hold the right to request evidence, before issuing any refund of the price paid and/or any associated delivery costs. If you discover that your Product is faulty after 14 days, we reserve the right to ask for evidence, such as images of the defective item, before issuing any refund of the price.

DISCOUNT CODES
Kounouz discount codes entitle you to a specified discount amount off your next online order from our website. To claim your discount, please “Apply Coupon” at the checkout.
Discount Codes may only be used once per customer and cannot be used in conjunction with any other promotion or offer, remain our property and are not transferable.
LIABILITY
Should there be any issues with your order regarding delivery or incorrect products, we are obligated to:
- make good of any shortage or non-delivery or incorrect delivery; or
- replace or repair any items that are damaged or defective; or
- refund the amount paid by you for the items in question
If you discover that your Product is faulty after 14 days, we reserve the right to request evidence, such as images of the defect, before issuing any refund of the price and/or any associated delivery charges.
We shall have no liability to you for any consequential, special or indirect losses including without limit loss of revenues, profits, contracts, business or anticipated savings damage to or loss of goodwill, reputation or data.
Our total liability to you under and/or arising in relation to this contract shall not exceed the amount paid by you for the order.
Nothing in this contract shall exclude or limit our liability for death or personal injury due to our negligence or any liability which is due to our fraud or any other liability.
Nothing in this contract shall exclude or limit your statutory rights.
A person who is not a party to this Contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Contract.
As required by law, some of the information or communication we send to you should be in writing, via email. For purposes of the contractual agreement, you agree to the electronic means of communication and acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement. This does not affect your statutory rights.
INTELLECTUAL PROPERTY
When using our site, you agree to adhere to the terms of this Terms and Conditions agreement with Kounouz. You agree that any and all information stored from our site is the intellectual property of Kounouz and its affiliates, partners, suppliers and licensors including copyrights, trademarks and other intellectual property. You agree not to redistribute or use any property of Kounouz without permission or royalties.
You agree to a royalty-free and non-exclusive license to copy, display and broadcast any content you may upload onto our app.
USER ACCOUNTS
Users agree to provide accurate and current information upon registration of their account and will update such as necessary. You remain responsible for ensuring the safety of your account and any activity that may occur under your account.
Should you be worried of any issues regarding the security of your account, you should contact us immediately, so we are able to resolve this.
Users agree not to use the app to carry out any illegal or non-permitted doings and will comply fully to the appropriate laws and regulations of the United Kingdom.
By using our site, you acknowledge and accept the inherent risks, characteristics and limitations of the internet, particularly in terms of technical performance of the site, response times to view, verify or transfer information, and the risks inherent in all third-party links, connections and transfers via the Internet.
We do not make any promises about the availability or accessibility of the site or promise that your access to the site, the content on it or the services we provide will be delivered uninterrupted, in a timely manner or error-free.
We reserve the right to terminate, edit and remove any content at our sole discretion.
USER CONTENT LIABILITY
When tagging the Kounouz account or using hashtags that relate to the Kounouz brand and its worldwide affiliates:
You grant Kounouz, its affiliates and/or related entities a worldwide, perpetual, irrevocable, royalty-free, non-exclusive, transferable right to use your video(s), photo(s) and/or other content posted to Instagram, Facebook, Twitter or Google+, together with your social media handle, social media username, profile picture, caption and location information you may have included in your content (“User Content”) that you have tagged with any of the Hashtag(s) defined below in any media, including but not limited to on its webpages and social media pages, retailer sites, third party sites, stores for its marketing and/or its advertising. You grant Kounouz the right to use your username, real name, image, likeness or other identifying information in connection with any use of your User Content.
Kounouz may use, display, reproduce, distribute, transmit, combine with other materials, alter and/or edit the User Content for legal and/or regulatory reasons in any way it sees fit (while maintaining the original sentiment), with no obligation to you whatsoever.
You may directly upload User Content or post User Content to your social media accounts. By uploading User Content and posting User Content that you have tagged with Brand hashtags to social media platforms, you grant to the Brand, its third-party service providers who provide content management services, and its retail partners (collectively, the “Licensed Parties”) the worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable right to use your uploaded or Brand-tagged User Content in any manner to be determined in the Licensed Parties’ sole discretion, including but not limited to on its webpages, social media pages operated by the Licensed Parties, promotional emails and advertisements, and in other marketing, promotional and advertising initiatives, in any media now or hereafter known. The Licensed Parties may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your User Content in any manner in their sole discretion, with no obligation to you whatsoever. You grant the Licensed Parties the right to use your username, real name, image, likeness, caption, location or other identifying information in connection with any use of your User Content.
You are solely responsible for any User Content that you submit. You are legally liable for the User Content that you submit including, for example, material protected by copyright, trademark, patent or trade secret law or other proprietary rights laws without permission of the author or owner or subject featured in such submission, or defamatory comments.
The User Content that you submit is deemed non-confidential and the Licensed Parties have no obligation to maintain the confidentiality of any information, in whatever form, contained in any submission, except pursuant to the Licensed Parties’ respective privacy policies.
The Licensed Parties reserve the right to remove any User Content from the Site, the Brand properties and the Services at any time, for any reason.
